Statement: R3.5 million suit against Roger Kebble

DRD’s R3.5 million suit against Roger Kebble for breaching a restraint of trade agreement was heard in the Johannesburg High Court today.

Johannesburg, South Africa – 30 March 2004 – Durban Roodepoort Deep , Limited (JSE:DUR; NASDAQ:DROOY; ASX:DRD) Durban Roodepoort Deep, Limited’s R3.5 million suit against Roger Kebble for breaching a restraint of trade agreement was heard in the Johannesburg High Court today.

Contrary to a media statement issued on behalf of Kebble this afternoon:

  • the Court did not reject DRD’s claim;
  • the action was not dismissed; and
  • it was not ruled that Roger Kebble was therefore not required to go to Court to answer the alleged charges.
Kebble’s counsel raised two technical objections against the way DRD’s claim was framed. One objection was upheld, the other was not.

In respect of the objection that was upheld, DRD has three courses of action open to it:

  • it may use a 20-day opportunity granted by the Judge to amend its summons;
  • it may appeal the finding; or
  • it can drop the suit.
DRD CEO Ian Murray has ruled out the third option.

“We will pursue this matter, on the advice of our legal team,” he said.
